Terms of Service

1. Agreement

These Terms of Service (“Terms”) are a binding contract between you and the operator of Cerise (“we”, “us”, “Cerise”) for use of cerise.lol, accounts, payments, APIs, downloads, and the Cerise client software (together, the “Service”).

By creating an account, paying for access, redeeming a key, signing in from the loader, activating a seat, or otherwise using the Service, you accept these Terms and our Privacy Policy. If you do not agree, do not use the Service and do not pay.

2. What Cerise is

Cerise is third-party software for personal use with Drakensang Online. It is not affiliated with, endorsed by, or sponsored by the game publisher or its partners. The publisher sets the game rules. Using third-party tools may violate those rules and may lead to loss of a game account. You use Cerise entirely at your own risk.

We provide digital access to software and online systems. Nothing here sells you ownership of the Service, source code, brand, or game content.

3. Eligibility

You must be able to form a binding contract under the laws that apply to you, and be at least 16 years old (or older if your country requires it for this kind of purchase). You must provide accurate account information and keep credentials secret. You are responsible for all activity under your account.

4. Accounts

• One natural person per account. No shared logins.
• Staff may assign roles (for example customer, staff, developer) solely for operating the Service. Roles do not create employment or ownership rights.
• Account status may be active or suspended. A suspended account may lose the ability to sign in, buy, link a seat, activate, download, or use the client, as we decide.

5. Suspension, bans, and termination

We may suspend, restrict, ban, or permanently terminate your account, revoke or disable any license or key, release or lock seats, block hardware identifiers, invalidate sessions, and refuse service at any time, with or without prior notice, for any reason we consider appropriate. That includes (without limitation) suspected abuse, fraud, chargebacks, seat sharing, reverse engineering, attacks on our systems, harassment of staff or users, violation of these Terms, or risk to the Service or other users.

We may act on hardware bans (HWID or related fingerprints) independent of your account, so a banned machine stays blocked even under a new login.

Enforcement decisions are final for access to the Service. Where the law allows, we do not owe a refund, credit, or replacement access when we suspend, ban, revoke, or terminate for cause or for protection of the Service. We are not required to restore a suspended or banned account.

6. Licenses, keys, and seats

• Paid or gifted access is a limited, personal, non-exclusive, non-transferable, revocable license to use Cerise while your access is valid and your account is in good standing. Keys (including prefixes such as CERISE-…) are credentials, not property you can resell.
• We may revoke, expire, suspend, reassign, or otherwise disable a license at any time when these Terms allow, including for abuse or chargebacks.
• Seats are typically limited (for example one active machine). Binding uses a hardware identifier and related checks. Self-serve seat moves may be rate-limited (about every 90 days unless we change the product rules). Extra moves are a courtesy when we choose to help, not a right.
• Cloud configs, profile data, and similar product data may be deleted or made inaccessible when a license or account ends.

7. Activation and digital delivery

The Service is digital. Access is considered delivered when any of the following first occurs after purchase or grant: your account is linked to a paid plan or key, a seat is bound (HWID link), a successful activate/session/link response is issued for your account or key, or you download and run the client under that access.

That is why we offer a short Trial plan. Use the Trial if you need to verify that Cerise runs on your setup before buying longer access.

8. Payments, chargebacks, and refunds

Checkout and card processing are handled by Creem as Merchant of Record. Prices are shown before you pay. Taxes may apply. Subscription renewals and customer-portal cancellation follow Creem’s flows for your purchase.

No refunds after activation. Once access is activated or delivered as described above, the purchase is final. We do not refund buyer’s remorse, unused remaining days after activation, game bans or publisher action, hardware changes, OS reinstalls, “I changed my mind,” or “it was not what I expected.”

If the software does not work on your machine: contact us through Discord or the support channels we publish. We will work with you in good faith to fix or work around the problem (for example configuration, updates, or seat moves when appropriate). Support and technical resolution are the remedy, not a cash refund, except where a mandatory consumer law in your country cannot be waived.

Chargebacks, payment disputes, or payment fraud after delivery may result in immediate suspension, license revoke, HWID ban, and denial of future service, in addition to any collection rights of the payment provider.

9. Acceptable use

• Do not share, rent, resell, or publicly redistribute builds or keys.
• Do not crack, spoof HWIDs, bypass seats, or reverse engineer for piracy or competitive abuse.
• Do not attack, scrape abusively, overload, or probe our APIs or infrastructure beyond normal client use.
• Do not use the Service to harass others or to break applicable law.
• Do not misrepresent staff status or impersonate Cerise support.

10. Monitoring and records

We log activations, sessions, links, denials, IPs, user agents, HWID hashes, and related events to operate seats, fight abuse, and support enforcement. We may use that data to suspend accounts, revoke licenses, and ban machines. More detail is in the Privacy Policy.

11. Updates, downtime, and no SLA

Game patches can break features until we ship a fix. We aim to restore useful function quickly and may add time to access when downtime is our fault, as a discretionary goodwill measure, not as a guaranteed service level. We do not promise uninterrupted or error-free operation.

12. Intellectual property

Cerise software, site content, branding, and documentation are owned by us or our licensors. Your license ends when access ends or when we revoke it. The game and its assets belong to their owners.

13. Disclaimer of warranties

To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that using Cerise will avoid publisher enforcement against any game account.

14. Limitation of liability

To the fullest extent permitted by law, we are not liable for lost game accounts, lost profits, lost data, business interruption, or any indirect, incidental, special, or consequential damages arising from the Service or these Terms. Our total liability for all claims related to the Service is limited to the amount you paid for Cerise access in the three months before the claim, or zero if you paid nothing.

15. Indemnity

You will defend and indemnify us against claims, damages, and costs (including reasonable legal fees) arising from your use of Cerise, your game-account outcomes, your violation of these Terms, or your violation of any third-party rights or laws.

16. Changes

We may change these Terms at any time. The “Last updated” date will change when we do. Continued use after an update means you accept the new Terms. If you do not accept a change, stop using the Service.

17. General

If a court finds part of these Terms unenforceable, the rest still applies. Our failure to enforce a right is not a waiver. You may not assign these Terms. We may assign them as part of operating or transferring the Service. These Terms are the entire agreement on the Service between you and us, and replace prior conflicting statements unless we sign a separate written deal with you.
